About the Firm

Read and Laniado, LLP, an Albany, New York law firm, was founded in 1983. The Firm represents clients before federal, New York State, and local agencies and boards regarding energy, competitive markets, ratemaking, environmental, siting, and related regulatory matters.

The Firm is involved with the certification and development of electric generating and storage facilities, as well as the siting of gas and electric lines. Read and Laniado is fully versed on the comprehensive renewable generation siting laws in New York State—Executive Law Section 94-c and Article 10. The Firm was fully involved in negotiations to reenact Article 10 in 2011, advised clients during the promulgation of the Section 94-c regulations, and counseled applicants on five applications under Article 10’s predecessor, Article X.

To date, Read and Laniado has counseled four Article 10 wind and solar projects through the certification process and is working with many others currently in the application process. The Firm is also currently counseling clients engaged in the Section 94-c process.

Read and Laniado supports the development of solar, wind, electric storage, and other renewables and distributed generation projects throughout their application processes, including Section 94-c, Article 10, and the State Environmental Quality Review Act (“SEQRA”). The Firm represents developers of multiple utility-scale renewable energy projects and is familiar with issues related to the development of community distributed generation projects.

Read and Laniado is actively involved in matters before the New York State Public Service Commission (“PSC”), the Office of Renewable Energy Siting (“ORES”), the New York State Board on Electric Generation Siting and the Environment, the New York Independent System Operator (“NYISO”), the New York State Department of Environmental Conservation (“DEC”), the New York State Department of Transportation (“DOT”), the New York State Energy Research and Development Authority (“NYSERDA”), the Federal Energy Regulatory Commission (“FERC”), municipal zoning and planning boards, and State and federal courts.

Read and Laniado represents energy market participants, including wholesale electric generators in connection with the development and implementation of wholesale electric markets, NYISO rules and tariffs, interconnection procedures, contracts, rates, electric utility industry restructuring, financing, power purchase, and asset purchase and sales transactions. The Firm also represents energy service companies on all aspects of retail electric service and has worked with and advised lender’s and borrower’s counsel, as well as industrial development authority counsel, in financial transactions.

Read and Laniado has extensive experience in New York State’s municipal laws and practices relating to electricity and natural gas. The Firm also regularly advises independent power producers and municipal electric systems on a broad range of regulatory issues. In addition, Read and Laniado represents water companies and municipal electric and gas departments on issues such as ratemaking, mergers, creation, and other regulatory matters.

Read and Laniado’s experience in the regulatory field has also afforded it knowledge of New York State’s Eminent Domain Procedure Law and the way it is implemented.
